Legal Precedents and Perturbations Shaping US Broadband Policy

One of the major lessons I learned from Ithiel de Sola Pool’s Technologies of Freedome book was the importance of legal precedent in communication policy, and particularly telecommunications policy. Pool also acknowledged that while legal precedent provides stability and continuity in policy, it also risks becoming an impediment to progress when technology changes beyond the scope of existing laws.

The Democrats finally regained majority control of the FCC when a new nominee, Anna Gomez, was confirmed by the US Senate on September 7, 2023. With a new majority they could effectively address and rule on significant Internet issues, including net neutrality.

Despite the design and the efforts of the Clinton-Gore administration to create a competitive environment, the Internet came to be increasingly controlled by a small number of ISPs. It is important to understand the policy environment and administrative actions that changed the Internet into the oligopolistic market structure that dominates broadband today. Policy changes allowed telcos to transition from the neutral transmitters of communication to the communicators themselves.
